K-1 Fiancé(e) Visa

The K-1 visa allows the foreign fiancé(e) of a U.S. citizen to enter the United States with the intention of getting married within 90 days.

Eligibility Criteria

- Must be a fiancé(e) of a U.S. citizen.

- Both parties must be free to marry and intend to marry within 90 days of entry.

- Must have met in person at least once in the two years preceding the application.

Process

1. The U.S. citizen files a petition for the foreign fiancé(e).

2. Once approved, the foreign fiancé(e) applies for a K-1 visa.

3. Attend an interview at a U.S. embassy or consulate.

4. If approved, enter the U.S. and get married within 90 days.

5. Apply for Adjustment of Status to become a permanent resident.

Points to Consider

- Failing to marry within 90 days results in the necessity to leave the U.S.

- Marriage must be genuine and not for the purpose of obtaining immigration benefits.
