H-1B Visa to Green Card

The H-1B visa is a non-immigrant visa that allows U.S. companies to employ foreign workers in specialty occupations. 

Many H-1B visa holders eventually transition to permanent residency through employment-based green card options.

Eligibility Criteria

- Must hold a valid H-1B visa and be employed by a sponsoring U.S. company.

- Occupation should be considered a "specialty occupation," requiring a bachelor’s degree or higher.

Process

1. Employer submits a PERM Labor Certification.

2. Employer files Form I-140, Immigrant Petition for Alien Worker.

3. Wait for a visa number to become available.

4. Apply for Adjustment of Status.

Points to Consider

- Subject to annual H-1B cap and visa backlogs.

- Must maintain H-1B status until Adjustment of Status is approved.

- Employer sponsorship is essential.
