Long-Term Nonimmigrant Status Conversion (Adjustment of Status)

Certain nonimmigrant visa holders in the U.S., such as those on H-1B work visas or F-1 student visas, may be eligible to adjust their status to permanent residents under specific conditions.

Eligibility Criteria

- Must be physically present in the U.S. under a valid nonimmigrant status.

- Eligible for an immigrant visa based on family or employment sponsorship, or other specific categories.

- Must have maintained legal status and not violated the terms of the current visa.

Process

1. Wait for a visa number to become available, based on family or employment-based categories.

2. File Form I-485, Application to Register Permanent Residence or Adjust Status.

3. Attend a biometrics appointment and an interview.

4. Upon approval, receive a green card, granting permanent resident status.
