VAWA (Violence Against Women Act) Green Card

The Violence Against Women Act (VAWA) allows certain spouses, children, and parents of U.S. citizens and certain spouses and children of permanent residents to file for a green card without the abuser's knowledge.

Eligibility Criteria

Must be a victim of battery or extreme cruelty by a U.S. citizen or permanent resident spouse, parent, or child.

Process

1. File Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant.

2. Once approved, if you're in the U.S., you can file Form I-485, Application to Register Permanent Residence or Adjust Status.

3. Attend a biometrics appointment and an interview.

4. Receive a green card upon approval.

Points to Consider

- You can self-petition, meaning you don't need your abuser to sponsor your application.

Confidentiality provisions are in place to ensure the safety of the applicant.
