O-1 Visa to Green Card

The O-1 visa is designed for individuals who possess extraordinary ability in the sciences, arts, education, business, or athletics.

Many O-1 visa holders transition to U.S. permanent residency through employment-based green card categories, particularly the EB-1A for individuals with extraordinary ability.

Eligibility Criteria

- Must hold a valid O-1 visa and demonstrate extraordinary ability in your field.

- Generally must have a U.S. employer willing to sponsor your green card application.

Process

1. Employer or self-petitioner files Form I-140, Immigrant Petition for Alien Worker, under the EB-1A category.

2. Wait for a visa number to become available.

3. File Form I-485, Application to Register Permanent Residence or Adjust Status.

4. Attend a biometrics appointment and an interview.

5. Receive a green card upon approval.

Points to Consider

- EB-1A category does allow for self-petition, meaning you don't necessarily need employer sponsorship if you meet the criteria.

- O-1 visa holders often find it easier to meet the criteria for the EB-1A green card category due to similar eligibility requirements.
