Religious Workers (R-1) to Green Card

The R-1 visa is for foreign nationals who are coming to the U.S. temporarily to be employed at least part-time by a non-profit religious organization. R-1 visa holders may be eligible to apply for a green card under the EB-4 category for Special Immigrant Religious Workers.

Eligibility Criteria

- Must hold a valid R-1 visa.

- Must have been employed by the sponsoring religious organization for at least two years prior to filing the green card application.

Process

1. Employer files Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant.

2. Wait for a visa number to become available.

3. File Form I-485, Application to Register Permanent Residence or Adjust Status.

4. Attend a biometrics appointment and an interview.

5. Receive a green card upon approval.

Points to Consider

- The EB-4 category for religious workers has certain caps, and backlogs may exist.

- The religious organization must provide documentation proving its non-profit status and the legitimacy of the religious work involved.
