U Visa to Green Card

The U visa is for victims of certain crimes who have suffered substantial mental or physical abuse and are willing to assist law enforcement and government officials in the investigation or prosecution of criminal activity.

Eligibility Criteria

- Must be a U visa holder.

- Must have been physically present in the U.S. for at least three years while holding a U visa.

Process

1. File Form I-485, Application to Register Permanent Residence or Adjust Status.

2. Attend a biometrics appointment and an interview.

3. Receive a green card upon approval.

Points to Consider

- The pathway from a U visa to a green card is generally less straightforward and may require substantial supporting documentation.

- There is a limit of 10,000 U visas issued per fiscal year.
